Course Overview
An introduction to the legal aspects of construction contracts. Topics include an overview of the construction industry, contractual responsibilities and relationships between the parties to a construction project, bonding, liens and holdbacks, tendering, types of construction contracts, contents of bid and contract documents and the application of typical clauses to construction related issues.

Learning Outcomes
Upon successful completion of this course, the student will be able to:
Module 1 - The Construction Industry - A Synopsis
- List the personnel involved in the development and design processes and define their duties and responsibilities.
- List the major personnel involved in the construction process and define their duties and responsibilities.
- Define and discuss the relationships between the personnel involved in the development, design and construction processes.
- Describe the development of a project from conceptualization through to construction completion.
Module 2 - Contract Law and Supplemental Data
- State and discuss the four basic requirements to form a contract.
- Define the concept of a 'surety bond'.
- Describe the purpose of each of the three types of surety bonds used in construction.
- Define and discuss the concept of a 'builders lien'.
- Define and discuss the ramifications of breach of contract by the contractor and/or the owner.
- Define and discuss the concept of 'liquidated damages'.
- Describe the process of advertising for bids.
- Write an 'Invitation to Bid.'
Module 3 - Types of Construction Contract
- Identify the three primary types of construction contract and their derivative forms.
- Explain the advantages and disadvantages of the different types of contract from the point of view of both the owner and the contractor.
- Choose the type of contract most appropriate for a particular type or method of construction.
Module 4 - The Bid and Contract Documents
- Identify and describe the contents of a set of bid documents.
- Employ a set of bid documents to assist in the preparation of an estimate.
- Employ a set of bid documents to assist in executing a contract.
- Identify the location within the documents of provisions to deal with common contractual problems.
- Employ a set of contract documents to assist in the administration of a project.
